Edo High Court Judgement: Fate of Orbih's camp and Wike's N180m

This is because today's victory is a A JUDGEMENT and not an INJUNCTION or something of the sort. This article will explain even further.

With today's Edo High Court judgement giving credence to Governor Godwin Obaseki's delegates list and its onward usage in the forthcoming primaries, there has been an uneasy calm and deafening silence in the camp of Orbih and Ogbeide-Ihama.

For starters, the legal position will suffice to explain some gray areas.

What is the legal position on the conduct of congresses and primaries of political parties under the Electoral Act and the constitution of the Federal Republic of Nigeria? 

The Courts over the years has held that the conduct of congresses and party primaries is the internal affairs of parties and the role of INEC is observatory as the political parties are solely in charge.

In Hon Akpatason Ohiozoje vs Hon Kabiru Adjoto, the Supreme Court held that the NEC of the party is in charge of party primaries while officials engaged at the state level are agents of the NEC and cannot therefore declare winners of primaries. 

In that case Hon Adjoto collated field results of the primaries duly monitored by INEC on the basis of which he was declared the winner of the primary. The five man team from the National headquarters duly appointed to conduct the primaries disagreed and announced Hon Akpatason as the winner of the primaries.

The supreme Court judgement affirmed the age long tradition that the parties are the sole and final authority in the conduct of congresses and party primaries. Also in Senator Ubah vs Celestine Ozigbo the NEC of PDP appointed His Excellency Rt Hon Comrade Philip Shaibu to held a five man Electoral Committee where Hon. Barr. Ijegbai Jimoh was a member. They proceeded to the Dora Akinyuli Centre Akwa to conduct the Governorship primaries where Celestine Ozigbo emerged winner. Another group supported by INEC proceeded to the Akwa Stadium where Senator Ubah emerged as winner.

The Supreme Court declared Celestine Ozigbo as the authentic candidate of PDP in the Governorship of last year in Anambra as the political party are duly in charge of party primaries not INEC.

The position of the Law has not changed, political parties have Electoral Committee for each state and whatever result is returned by the committee and accepted by NEC remains valid and authentic.

INEC is responsible for the conduct of the real election not party primaries and congresses. It is an exercise in futility and crass ignorance to flaunt INEC result in party primaries and congresses which is even fake to begin with.

With the foregoing, Wike's N180m has definitely entered the drain and Orbih and Ogbeide-Ihama remains persona non grata in Rivers as the duo have failed to procure victory for the Rivers godfather.
