BREAKING: Orbih, Ogbeide-Ihama gets bloody nose again as Court declines injunction to exclude ad-hoc delegates from voting in forthcoming Edo PDP primaries [DETAILS]



Today, an Edo State High Court has refused to grant an interlocutory injunction seeking to restrain the Peoples Democratic Party(PDP) and its National Chairman, Senator Iyorchia Ayu from allowing the ad hoc delegates that emerged from the party's ward congress held over a fortnight ago across all the wards in Edo State from participating in the primaries taking place on Sunday this week and Monday next week, respectively. 

The action was instituted by one Mr. Eghe Adun, an old PDP member loyal to the South South Vice Chairman of the PDP, Chief Dan Orbih and a House of Reps Member Hon. Omoregie Ogbeide-Ihama. The matter which was earlier filed in Abudu was transferred to High Court No. 1, Benin City on the order of the Chief Judge of Edo State, who heads that court. 


It is believed that the transfer was necessitated by a policy document issued to heads of court by the National Judicial Council (NJC), which discourages the filing of cases in jurisdictions outside the judicial division of the cause of action.

Listed as defendants in the case with suit number HAB/46/2022 are the Peoples Democratic Party, Senator Iyorchia Ayu, Dr Tony Aziegbemi and His Excellency, Godwin Obaseki. The court sitting in Benin city refused to grant the interlocutory application, but deferred hearing in the matter to the 7th of June 2022. The party primaries which the interlocutory order, if granted, would have prevented comes up on Sunday the 22nd of May, 2022.

It will be recalled that an Edo State High Court upheld the Edo PDP ad-hoc delegates election conducted by the 3 man team from the PDP national headquarters. The Edo State High Court upheld the Ad-hoc delegates election conducted by the Dr. Kingsley Emu-led Edo Peoples Democratic Party (PDP) Ward Electoral Committee for the party's primary elections.

The judgement delivered by Hon. Justice Vestee Otumaye Eboreime held that the election is valid.

The judgment paves the way for the elected 3-man delegate to participate in the election in order to elect candidates that will fly the PDP's flag in the upcoming general elections.

With this development, the attempt to stop the ad hoc delegates loyal to the Governor from voting in the party primaries has met a brick wall.
